PORTRAIT CONTRACT FOR MAKER'S PRICING

Copyright and Ownership: I acknowledge that images created by Sarah Sovereign Photography remain copyright and property of Sarah Sovereign Photography. I understand that digital files are released to the CLIENT for business use only, which includes advertisement, print, social media/online use, addition of text and business promotion. Images may not be edited by CLIENT via filters. Images may be shared on social media, a tag to Sarah Sovereign Photography is always appreciated, but not necessary.

Maker's Pricing terms: Maker's Pricing is a bimonthly or monthly experimental portrait subscription service for makers. Sessions are tailored specifically to create resources for maker's (CLIENT) to share images of their work for social media and print.

One Business Per Subscription: Maker's sessions may only be used towards the business that has signed up for the program. For example, if a maker has signed up to showcase their painting work, they may not use one of their subscription sessions to showcase an additional standalone pottery business, nor may sessions be used as or towards  family/wedding/non-business related sessions. This does not mean that CLIENT's children/family cannot appear in sessions, however, maker's images tend to be more documentary/lifestyle in nature.

Missed Payment: In the event that payment is not received for the owed month, Sarah Sovereign Photography will not continue with additional scheduled shoots, at her discretion, or until payment has been provided.

Payment: In order to qualify for Maker's Pricing packages, CLIENT understands that they must sign up for 3 sessions (paid either over 3 or 6 months). Should CLIENT choose to cancel the service before they have received 3 sessions, as pricing has been specially tailored for subscription, the full agreed upon total payment is still due. CLIENT understands that in signing up for Maker's Pricing, they will receive 3 shoots at special pricing, and the final total is due regardless of whether or not they complete 3 sessions. I understand that full payment is required at the start of or prior to the session, and that late payments will be billed at $50/day if previous arrangements with Sarah Sovereign Photography have not been agreed upon. Sneak peeks will not be shown online until full payment has been made, retainers will be applied to the unpaid session fee, and files from unpaid sessions will be deleted after 30 days, unedited. Additional fees may apply for: extensive edits, added people, travel and returned payments (bounced cheques, etc). ***If payment becomes an issue, please know you can reach out to me at any time to discuss.

Missed Sessions: 24 hours notice must be given for rescheduling, except in the case of illness or emergency. No shows will be charged the full rate. Please get in touch if you need support or flexibility around attending a session.

Covid: Due to Covid, if anyone in the household is feeling unwell or displaying symptoms (sore throat, cold/flu symptoms, loss of taste/smell, etc) the session will be rescheduled. Please get in touch as soon as possible so we can look at options. If you have been in direct contact with anyone who has tested positive, sessions will be rescheduled. If you are actively quarantining, sessions will be rescheduled.

Session Fee: CLIENT understands that they are paying for a special session fee (time & talent of the photographer) only, and that extra digital files, print, design work, reshoots, hair/makeup/floral pieces, etc, are subject to additional cost. 

Model Release: I grant unrestricted, irrevocable permission to Sarah Sovereign Photography to use, display, publish, print and exhibit images and/or video taken of me, my business, employees representing my business during the shoot, or of a minor of whom I am a parent/legal guardian (should they be involved in the shoot). Permission may include, but is not is limited to, photographic competitions, the Internet, mixed media artworks, and art gallery exhibitions. I release all claims to any profits that may arise from these endeavours, and hereby release Sarah Sovereign Photography and its legal representatives and assigns from all claims and liability in relation to said photographs/video/works.

Reshoots: I understand that requested reshoots due to factors outside of Sarah Sovereign Photography’s control (including but not limited to: appearance, outfits, behaviour, tardiness) will be billed at regular photography rates as a new session. Late arrivals will not extend the session time. For this reason, Sarah Sovereign Photography is not responsible for the limited amount of gallery images produced via shortened session times. Sarah Sovereign Photography is not responsible for unprepared workspaces, products, or crew, and the time taken to prepare during the session will count towards the overall session time. 

Liability: Sarah Sovereign Photography takes the utmost care with all files, but in the event of loss or damage outside of her control (including but not limited to: card / camera / hard drive malfunction, fire, theft), I agree Sarah Sovereign Photography will only be liable for refunding the price of the overall session or providing a reshoot.  

Archived Files: Once images are delivered to the client, images are archived. A $100 unarchiving fee will be charged for re-delivering files after 30 days, per retrieval. Images are archived for a limited amount of time, at photographer's discretion. I acknowledge that it is CLIENT's responsibility to back up all files, and Sarah Sovereign Photography is not responsible for files after they have been delivered. (Online backups like BackBlaze.com or Dropbox, as well as a USB placed in a fireproof safe). I understand that digital files are nonrefundable, and, once files have been downloaded (from the gallery, or sent as a download link), no refunds will be given. 

Editing: Editing includes image processing for tone, colour, exposure, sharpness and grain. Extensive edits (photoshopping, head swapping, airbrushing, etc) may be available at an additional charge, dependent upon request. Editing can take up to 6-8 weeks – in the event that editing should take longer, Sarah Sovereign Photography will be in touch as soon as possible. Rush orders may be available for additional fees. 

The Photographer (Sarah Sovereign) and licensees or assignees may have unrestricted use of these for whatever purpose, including advertising, with any retouching or alteration without restriction.
